Terms & Conditions (Tongues’ API software)
These API Terms and Conditions (“Terms”) apply to the use of the Application Programming Interface (API) Services provided by TONGUES Translation Services (“TONGUES”) to Business-to-Business (B2B), Business-to-Enterprise (B2E), Business to Non-Profit/NGOs, and for development firms and individual developers.
By accessing or using Tongues’ API software provided as a Software as a Service (SAAS) solution, you agree to be bound by these Terms. We do not provide consumer grade services. If you do not agree with any part of these Terms, please refrain from accessing the Service.
- Intellectual Property
Tongues’ API software, along with its original content, features, and functionality, are the exclusive property of TONGUES Translation Services and its licensors.
- Links to Third-Party Sites
Tongues’ API software may include links to third-party websites or services not owned or controlled by TONGUES. TONGUES is not responsible for the content, privacy policies, or practices of any third-party websites or services. You agree that TONGUES shall not be liable for any damages or losses resulting from the use of or reliance on such third-party content, goods, or services.
- Termination
TONGUES reserves the right to terminate or suspend access to the API software without prior notice or liability for any reason, including a breach of these Terms. Provisions such as ownership, warranties, indemnity, and limitations of liability shall survive termination.
- Disclaimer
Your use of the API software is at your own risk. Tongues’ API software is provided on an “AS IS” and “AS AVAILABLE” basis, without any warranties, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, non-infringement, or course of performance.
- Governing Law
These Terms shall be governed by the laws of the United States without regard to its conflict of law provisions. Failure to enforce any right or provision of these Terms will not be deemed a waiver. If any provision is found invalid or unenforceable, the remaining provisions will remain in effect.
- Changes
TONGUES reserves the right to modify or replace these Terms at any time. Significant changes will be notified with a 30 days’ notice. By continuing to use Tongues’ API software after such changes, you agree to the revised Terms. If you do not agree, please discontinue use of the Service.
- Payments for Services
TONGUES provide services that may require deposits, setup fees, usage fees, individual seats, or concurrent connections fees. These fees have various payment policies, and by choosing to use TONGUES services, you agree to be bound by the payment terms for each respective service you agree to use. Overdue payments, cancelled subscriptions, and unpaid accounts may require a disruption to the services we provide, your account may be suspended, cancelled or deleted.
